     1.   Description of the Technology.

When David Haymes says "paint runs in my veins", he really means it. Haymes Paint, started by his father Henry, isn't just a business to David, it's an obsession. And with the whole Haymes family actively involved in the business including son-in-law Rodney Walton as General Manager, you know that obsession will continue to support the Company throughout the next century. Making the best paint, building the best paint factory, having the best employees and, of course, only having paint sold through the best paint specialists.

Haymes was established in Ballarat in 1935 and has developed from a relatively unknown paint manufacturer in Victoria to a bustling business supplying premium quality products through specialist paint shops across the nation. The Haymes passion within the industry has resulted in the company offering a distinct point of difference in a highly competitive industry.      2. The Products

Natures Palette Low Sheen Acrylic: A specially formulated, environmentally friendly paint. Nature's Palette Low Sheen Acrylic has no added solvents- making it greater than 99% VOC free and virtually fume free. It is a scrubbable, washable, stain-resistant paint that delivers superb coverage with minimal roller splatter and is water wash-up.

Natures Palette Ceiling White: A specially formulated, environmentally friendly paint. Nature's Palette Ceiling White has no added solvents- making it greater than 99% VOC free and virtually fume free.

Natures Palette Acrylic Sealer Undercoat: A specially formulated, environmentally friendly preparatory paint. Nature's Palette Sealer Undercoat has no added solvents- making it greater than 99% VOC free and virtually fume free. It offeres superb adhesion, coverage and filling properties with minimal roller splatter.

Core Environmental Performance Characteristics
Fitness for Purpose
Certified products should be good performers in their intended application. It is implied that certain standards of product performance are implicit in the label. Certified product must ensure that the product is fit for its intended purpose
The manufacturing site of Henry Haymes has been certified ISO 9001:2000 (Expires 28/11/2009). Henry Haymes has provided an ISO 9001:200 audit report 1-2/11/2007 from Benchmark certification which states that the manufacturing site is compliant with ISO 9001:2000 requirements. Henry Haymes has been assessed against the Australian Paint Approval Scheme (APAS) and has been registered as a recognised manufacturer. The nominated product lines are certified under APAS and have the APAS product ID's NPASU = 4609, NPLSAW = 4610, NPCW = 4611. All of the nominated product range produced by Henry Haymes paints has been tested under AS/NZS 1580.401.6 for hard dry condition by CSIRO laboratories which include composition, binder solids, volatiles, additives, density and non volatile content by mass. The Henry Haymes nominated products are manufactured under an internal quality assurance regime, all product batches are tested internally for Stormer viscosity, Cone and Plate Viscosity, Tint Strength and Gloss on a batch by batch basis. Henry Haymes Laboratories are NATA accredited (accreditation No. 3794) dated 22/12/1992. The Henry Haymes products are available in the market place and have been accepted as fit for purpose.
VOC Levels Compliance to these criteria can be demonstrated by the VOC levels of the base paints with or without pigments. The scope of the final certification will reflect the scope of the VOC testing as described below. Conformance with these requirements listed in Table 1 shall be demonstrated by providing test reports from laboratories accredited to carry out the relevant tests and/or calculations and appropriate documentation of production methods and quality controls. The results of product VOC emission levels is presented in the table above, the figures presented have been calculated based on the known VOC levels of the nominated paint products (GECS has received formulation data for all products). The raw calculated data was reviewed on site as part of the site assessment and the final results of this desktop calculation based on individual VOS's or ingredients has been made available to GECS as an officer declaration. Based on this information the products are in conformance to the requirements of this criterion

The above results are compliant with the requirement of this criterion. Figures are based on the recommended spread rate for the paint products and formulation lists as supplied by Henry Haymes during a site assessment.

Glycol Ethers
Should not contain glycol ethers as listed.
Paint formulation information received by GECS shows that the nominated products do not contain the glycol ethers listed in Table 2 of criterion 4.2. All ingredients have been assessed for compliance to this criterion.

In addition GECS has sought Henry Haymes to provided a statement which declares that none of the glycol ethers mentioned in Table 2 of criterion 4.2 are contained in the nominated product lines under assessment. Henry Haymes has provided this confirmation.

Heavy Metals
Sb, Ba, Cd, Pb, Cr, Hg, and Arsenic or any toxic heavy metals and their compounds shall not be added during production. The use of Barium Sulfate (Barite) is excluded from this limitation.
Paint formulation information received by GECS shows that the nominated products do not contain any of the heavy metals: Sb, Ba, Cd, Pb, Cr, Hg, or Arsenic and that toxic heavy metals and /or their compounds are not added during production. All ingredients have been assessed for compliance to this criterion.
Packaging Requirements Chlorinated or halogenated plastics must not be used in product packaging. Used packaging shall be able to be recycled by local recycling systems. The nominated products are packaged in steel tin plate containers. This was confirmed during a site assessment. This material is readily recyclable in Australia once the packaging has been cleaned. It is recommended in the future that Henry Hames consider a plastic contained for packaging.
Carcinogenic substances
Approved paints should not contain substances listed as carcinogenic by the International Agency for Research of Cancer (lists A, B1) at a rate of exposure not exceeding one twentieth (1/20) of those defined by exposure standards determined by the National Occupational Health and Safety Commission (Worksafe Australia).
Paint formulation information received by GECS shows that the nominated products comply to the restrictions in this criterion. There is some crystalline silica in one of the ingredient mixes which is classed as a Class 1 carcinogen however in assessing this criterion GECS needs to consider pathways to exposure. This material is classed as carcinogenic with inhalation exposure. In this case the small amounts of crystalline silica are about to the pain film during use and is not considered a risk during application nor use of this product range.

All other ingredients have been assessed for compliance to this criterion.

Restricted Substances
Alkyl phenol alkoxylates (APEO's) shall not be added during production.
Paint formulation information received by GECS shows that the nominated products comply to the restrictions in this criterion.
Use of Ozone-depleting Substances in Industrial Solvents and Cleaning Agents The solvents used to clean the production equipment of architectural coatings must not contain ozone depleting substances as listed in Annex A, Annex B and Annex C of the Montreal Protocol. The nominated products meet the requirements of this criterion.
Solvents
4.9.1 The paint shall not be formulated or manufactured with more than 20% by weight of hydrocarbon solvents, based on the total formulation. 4.9.2 The paint shall not be formulated or manufactured with aromatic hydrocarbon solvents. 4.9.3 The paint shall not be formulated or manufactured with halogenated solvents. 4.9.4 The paint shall not be formulated or manufactured using ethylene glycol as an integral part of the paint formulation.
There are no solvents used in the nominated product lines.
Compliance to Environmental Regulations
The applicant is required to comply with relevant environmental legislation and government orders at the Local, State and Commonwealth level, if these have been issued. An applicants compliance with this criteria may be established by undertaking a series of random checks and gathering samples of applicant operational procedures and documents by approved assessors as evidence to support compliance during the verification and /or a statement of self declaration by an executive officer of the applicant organisation.
Henry Haymes has provided test results for the total concentration and leachability for both nitrates and zinc which is derived from the water based paint sludge extracted as waste from the manufacturing process. The sludge is tested under AS 4493.3 from Amdel Ltd which is a NATA accredited laboratory. These test results show that the levels were well below the required levels. Henry Haymes have embarked on installing a reticulated waste water system which will reduce the use of potable water by 350KL per annum. The water recycled has been shown to produce paint to the same requirements as the potable water currently being used. The pump involved in this process has caused problems and is currently in the process of being replaced. The reticulated water system is yet to be in consistent working order. Henry Haymes has expressed that this will happen shortly. Henry Haymes has provided details of a National Pollutant Inventory 2007. The inventory mentions the fuels used and the VOC present in the ingredients. The report also details some steps which have been made in regards to cleaner production activities, the installation of pollution control equipment and other emission reduction information. Henry Haymes have had a loss of containment incident in which 330 Litres was spilled into the sewerage system. The spill was contained and treated promptly. None of the waste water reached the creek. The water entering sewerage after the clean up process was clear. The composition of the waste water was considered non hazardous according to USSPD (Standard for the Uniform Scheduling of Drugs and Cooling) and Australian Dangerous Goods code 6. The level of aquatic toxic materials did not exceed 175ppb which is below the levels required. Henry Haymes has a plan to install manual isolation of the boundary storm water in agreement with the EPA. Henry Haymes was fined $210 for the infringement. Henry Haymes has provided a copy of the infringement notice to GECS.
Compliance to Labour, Anti-Discrimination & Safety Regulations
An applicant shall demonstrate that all employees are covered by a Federal or State award or a certified industrial agreement or a registered workplace agreement as determined by the Industrial Relations Commission, the Employment Advocate or a State or Territory Workplace Relations Agency.
For compliance of the Henry Haymes Pty Ltd to the requirements of this criterion GECS inspected the following:
o Certificate of currency, policy number 1003543.
o Sample pay slip and award information.

In addition GECS received a statement from Rodney Walton the General Manager of Henry Haymes Paint Pty Ltd stating compliance to all applicable social regulations has occurred in the last two years.

        3. Environmental and Social Regulatory Obligations:

 

GECA also found the Haymes Paint range to be fully compliant with their obligations under Labour, Anti-Discrimination, and Safety Regulations. The company has not been the subject of prosecution in relation to compliance with labour, anti- discrimination, safety regulations and environmental regulations.
